Leo's Fortune Speedrun Contest Terms and Conditions

 

1. Introduction

 

Welcome to the Leo's Fortune Speedrun Contest ("Contest") hosted on leosfortune.com/speedrun ("Website"). By participating in the Contest, you agree to comply with and be bound by the following terms and conditions ("Terms"). Please read these Terms carefully before participating.

 

2. Eligibility

 

- The Contest is open to individuals who are at least 18 years old or have reached the age of majority in their jurisdiction. Minors can participate and be represented by their guardians by written consent only.

- Employees, affiliates, and immediate family members of Leo's Fortune ("Organizer") are not eligible to participate.

- Participants must have a valid email address, the game Leo’s Fortune, and access to the Internet.

 

3. Contest

 

- Objective: Participants are challenged to complete the first 10 levels of Leo's Fortune in the shortest time possible.

 

- Period: The Contest begins on August 26th when the Speedrun is announced on Leo’s Fortune social media channels - Instagram, TikTok, Facebook, Steam, Discord, etc. - (“Channels”) approximately at 18:00 CET and ends at 23:59 CET on September 30th ("Contest Period").

 

- All submissions must be received by 23:59 CET on September 30th.

 

- Winners will be announced on October 3rd, 2024 on Leo’s Fortune social media channels.

 

4. How to Enter

 

- Participants must upload their gameplay video to a platform that supports the video length (e.g., YouTube).

- Participants must submit their entry via the submission form on the Website (https://www.leosfortune.com/speedrun/#form) , including the link to their gameplay video.

 

5. Submission Guidelines

 

- The gameplay video must be unedited and show the entire first 10 levels completion (from the first to the tenth level of the game) from start to finish.

- Participants must adhere to the rules and guidelines provided on the Website (https://www.leosfortune.com/speedrun) .

- Any form of cheating, hacking, or use of exploits will result in disqualification.

 

 6. Winner Selection

 

- The winner will be the participant with the fastest completion time for all the first 10 levels of Leo's Fortune.
 

- In the event of a tie, the earliest submitted entry will be deemed the winner.
 

- The winner will be notified via email after the Contest Period ends.

 

- The winner must respond to the notification email within 72 hours to confirm acceptance of the Prize and provide any required information, such as shipping details and tax documentation.

 

- If the winner does not respond within the specified time frame, or if the notification email is returned as undeliverable, the Organizer reserves the right to disqualify that winner and select an alternate winner based on the next fastest completion time.

 

- The Organizer is not responsible for any failure to receive or respond to the notification due to issues such as spam filters, incorrect email addresses, or other technical problems.


 

7. Prize

 

Prizes

 

1st Place: The first-place winner will receive:

 

  • One (1) Gold Coin

  • One (1) Leo Plushie

  • Digital Stickers

  • Digital Soundtrack
     

2nd Place: The second-place winner will receive:

 

  • One (1) Leo Plushie

  • Digital Stickers

  • Digital Soundtrack
     

3rd Place: The third-place winner will receive:

  • Digital Stickers

  • Digital Soundtrack

 

Prizes are non-transferable and cannot be exchanged for cash or other alternatives. The Organizer reserves the right to substitute any prize with another prize of equal or greater value if necessary. The Digital Stickers and Digital Soundtrack provided as part of the prize cannot be sold, traded, or otherwise transferred to any third party. Winners must not distribute, sell, or otherwise commercialize these digital items.

 

The Organizer will arrange for the delivery of physical prizes (Gold Coin and Plushie). The winner is responsible for any customs fees or additional charges that may apply. 

 

The Organizer is not responsible for any delays or issues arising from customs. For digital prizes, winners will receive their prizes via email or other digital means.

 

8. Intellectual Property

 

- By participating in the Contest, you grant the Organizer a non-exclusive, worldwide, royalty-free perpetual license to use, reproduce, distribute, and display your submitted content, including gameplay videos, for promotional purposes related to the Contest and the Organizer’s products and services.

- This license includes the right to modify, adapt, or create derivative works based on the submitted content, provided such modifications are in line with the original intent of the content.

- The Organizer agrees to use the content in a manner that does not misrepresent the participant's original work.

- Participants retain ownership of their original content but agree that any use by the Organizer under this license is final and cannot be revoked.

-  Participants will not receive any compensation for the use of their content beyond the prizes awarded in the Contest.

- Participants are responsible for ensuring that their submitted content does not infringe on the intellectual property rights of others and complies with all applicable laws and regulations.

- If participants do not wish to grant these rights, they should not submit content to the Contest.

 

9. Privacy

 

  • The Organizer is committed to protecting participants' privacy and personal data in accordance with applicable laws, including the General Data Protection Regulation (GDPR) for participants from the European Union.

  • General Data Protection Regulation (GDPR): If you are located in the European Union, your personal data will be processed in compliance with the General Data Protection Regulation (GDPR). The Organizer is committed to ensuring that your personal data is handled securely and transparently.

  • The Organizer collects personal data such as names, email addresses, and gameplay information for the purposes of administering the Contest and delivering the Prize. This data will be used only as described in the Organizer’s privacy policy.

  • Rights Under GDPR:

 

  • Access: You have the right to request access to the personal data the Organizer holds about you.

  • Rectification: You have the right to request correction of any inaccurate or incomplete data.

  • Erasure: You have the right to request the deletion of your personal data when it is no longer needed for the purposes for which it was collected.

  • Restriction of Processing: You can request restriction of processing under certain circumstances.

  • Data Portability: You have the right to receive your personal data in a structured, commonly used, and machine-readable format and to transmit it to another data controller.

  • Objection: You have the right to object to the processing of your personal data for certain purposes.

  • By participating in the Contest, participants consent to the collection, use, and processing of their personal data as outlined in the Organizer’s privacy policy, available on the Website (https://www.leosfortune.com/speedrun).

  • The personal data collected, including names, email addresses, and any other information provided during the Contest, will be used solely for the purposes of administering the Contest, contacting the winner, and delivering the Prize.

  • The Organizer will retain participants' personal data only as long as necessary to fulfill these purposes, after which the data will be securely deleted or anonymized, in accordance with applicable data retention policies.

  • Participants have the right to access, correct, or request the deletion of their personal data at any time. They also have the right to withdraw consent to the processing of their data, though this may affect their ability to participate in the Contest.

10. Limitation of Liability

 

  • To the fullest extent permitted by law, the Organizer’s total liability for any claims arising out of or relating to the Contest, whether in contract, tort, or otherwise, shall not exceed the value of the Prize awarded in the Contest, or a maximum of $ 400.00 USD, whichever is greater. 

  • The Organizer is not liable for any incidental, consequential, or punitive damages, even if advised of the possibility of such damages.

  • The Organizer shall not be held responsible for any delay, cancellation, or failure to conduct the Contest due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of God, war, terrorism, pandemics, governmental actions, labor disputes, technical failures, or any other events that would make it unsafe, impossible, or illegal to carry out the Contest. In such cases, the Organizer reserves the right to cancel, modify, or suspend the Contest without liability or obligation.

 

11. Taxes and Documentation

  • The winner is solely responsible for reporting and paying any applicable federal, state, and local taxes, as well as any other costs, fees, or expenses associated with the acceptance and use of the Prize.

  • The Organizer may require the winner to complete and submit tax documentation, such as a W-9 form (for U.S. residents) or other relevant forms, as a condition of receiving the Prize.

  • Failure to provide the required tax documentation within the specified time may result in disqualification, and the Organizer reserves the right to select an alternate winner.

  • The value of the Prize will be reported to the appropriate tax authorities as required by law.

13. Customs Fees and Import Regulations

  • The winner is responsible for any customs fees, import duties, taxes, or other charges that may apply when receiving the Prize.

  • The Organizer is not responsible for any delays, confiscations, or issues that may arise during the shipping process due to customs regulations in the winner’s country.

  • It is the winner's responsibility to ensure that the Prize can be legally imported into their country of residence. The winner should check the relevant import regulations before participating in the Contest.

  • If the Prize is undeliverable due to customs restrictions, the Organizer will not be obligated to provide an alternative prize or compensation.

14. Disqualification

  • Any form of cheating will result in immediate disqualification from the Contest. Cheating includes, but is not limited to, the use of third-party software, bots, or tools to gain an unfair advantage; exploiting game glitches or bugs; modifying the game or gameplay in any way; or submitting gameplay that is not the participant's own.

  • Participants are required to adhere to all rules and guidelines provided by the Organizer. Failure to do so may result in disqualification.

  • The Organizer reserves the right to investigate any suspicious activity and to disqualify any participant found to be in violation of these Terms. The Organizer’s decision regarding disqualification is final and binding, and no appeals or discussions will be entertained.

 

13. General

 

- The Organizer reserves the right to amend or terminate the Contest at any time without prior notice.

- The terms of the Agreement, and any dispute relating thereto will be governed by the laws of the State of New York, without regard to conflict/choice of law principles. Each party agrees to submit to the exclusive jurisdiction of the state and federal courts located in New York County, New York. 

- Participants who reside outside the United States agree to submit to the jurisdiction of the state and federal courts located in New York County, New York, for any actions arising out of or relating to these Terms or the Contest that are not subject to arbitration. However, nothing in these Terms shall limit a participant’s right to seek relief in their local jurisdiction where mandatory laws apply.

- Exceptions: The mandatory arbitration provision shall not apply to claims for injunctive or equitable relief, where such relief is necessary to protect the Organizer’s intellectual property or other proprietary rights.

- Participants agree to resolve any disputes on an individual basis, and not as a plaintiff or class member in any purported class, collective, or representative action.

- Any dispute, controversy, or claim arising out of or relating to these Terms or the Contest, including the determination of the scope or applicability of this agreement to arbitrate, shall be resolved by binding arbitration administered by The American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in New York County, New York, and shall be conducted in English.

- The Organizer reserves the right to amend, modify, or terminate the Contest at any time for significant reasons, including but not limited to legal or regulatory changes, technical issues, or other unforeseen circumstances that affect the integrity of the Contest.

- The Organizer will notify participants of any major changes to the Contest Terms or structure. Notification will be made through the Website or via email to the addresses provided by participants. Minor changes may be communicated through updates posted on the Website.

- In the event of termination of the Contest, the Organizer will not be liable for any costs or damages incurred by participants as a result of the termination. The Organizer will make reasonable efforts to inform participants of such termination in a timely manner.

- These Terms constitute the entire agreement between the participants and the Organizer regarding the Contest.

 

By participating in the Contest, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
